1. General information

This website and its online store are operated by Tiziana Piola. In this document, “we”, “our” and “Tiziana Piola” refer to the store owner.

The website uses the Shopify platform to enable catalogue browsing, cart management, checkout, payments and other services connected with online purchases.

By using the website or placing an order, you agree to these Terms and Conditions together with the other policies referred to herein, including the Privacy Policy, the Shipping Policy and the Refund Policy.

3. Requirements for purchasing

By placing an order, you declare that you have the legal capacity required to enter into the purchase contract and that the information you provide is accurate, complete and up to date.

If you place an order on behalf of another person, you declare that you are authorised to do so.

4. Products and craftsmanship

Tiziana Piola products are handcrafted creations. For this reason, they may show slight variations in shape, surface, texture, colour or finish compared with the images published on the website.

Natural stones may also vary in colour, veining, inclusions and other characteristics inherent to natural materials. Such variations do not necessarily constitute a product defect.

We make every reasonable effort to describe and represent products as accurately as possible, taking into account differences that may arise from viewing them on different devices and screens.

5. Prices

The applicable prices are those displayed on the website at the time the order is placed, except in the case of obvious errors.

Any shipping charges are shown before the purchase is completed. The total order amount is displayed at checkout before payment is confirmed.

6. Orders

Submitting an order constitutes an offer to purchase. The contract is concluded when you receive the order confirmation in accordance with the process provided on the website.

We reserve the right to refuse or cancel an order where permitted by law, for example in the event of product unavailability, an obvious pricing or information error, inability to process payment, or suspected fraudulent use of the service.

If an order that has already been paid is cancelled, any amounts received will be returned using the applicable method.

7. Payments

Available payment methods are displayed at checkout. Transactions may be processed by Shopify and/or third-party payment service providers.

We do not directly store full payment card details when payment is processed through the relevant providers' systems.

8. Shipping

Shipping conditions, costs and available destinations are described in our Shipping Policy.

Any delivery times indicated are estimates unless an essential delivery deadline has been expressly agreed.

9. Right of withdrawal and returns

Consumers who are entitled to do so may exercise the right of withdrawal within the time limits provided by applicable law.

Procedures, time limits, conditions and any exclusions are set out in our Refund Policy.

10. Personalised and Bespoke products

Products made to measure, personalised or created specifically according to the customer's instructions may be excluded from the right of withdrawal where provided by applicable law.

The characteristics, measurements, materials and other elements of a Bespoke project are agreed before production begins.

11. Order changes and cancellations

If you wish to change or cancel an order, contact us as soon as possible at commerciale@tizianapiola.it.

We cannot guarantee that a change or cancellation will be possible once the order has entered production or has been handed over to the carrier.

12. Defective or non-conforming products

All rights granted to consumers under applicable law regarding the legal guarantee of conformity remain unaffected.

If you receive a damaged, incorrect or allegedly non-conforming product, contact us promptly, describing the issue and, where useful, attaching photographs.

13. Intellectual property

Text, photographs, images, designs, graphic elements, logos, collection names and the Tiziana Piola trademark are protected by applicable copyright and intellectual property laws.

Reproduction, distribution or use of website content beyond purposes permitted by law is not allowed without prior authorisation.

14. Use of the website

The website may not be used for unlawful or fraudulent purposes or in any way that infringes the rights of Tiziana Piola, Shopify, other users or third parties.

You must not attempt to compromise the security, integrity or proper operation of the website or related services.

15. Third-party services and links

Some website functions may be provided through Shopify or other third-party services. These services may be subject to their own terms and policies.

The presence of links to external websites does not make Tiziana Piola responsible for the content or operation of third-party websites.

Personal data is processed as described in the Privacy Policy.

The website may occasionally contain material errors, inaccuracies or omissions. We reserve the right to correct such information and update website content where necessary.

Nothing in these Terms limits or excludes liability or rights that cannot be excluded or limited under applicable law.

To the extent permitted by law, we are not liable for disruptions or delays arising from events outside our reasonable control.

These Terms are governed by applicable law, without prejudice to any mandatory provisions protecting consumers under their own legal system.

Any alternative dispute resolution mechanisms available under applicable law remain available.

The former European Online Dispute Resolution (ODR) platform has been discontinued and is no longer available for submitting new complaints.

20. Changes to these Terms

These Terms may be updated to reflect regulatory, operational or service changes. The version applicable to an order is the version in force when the purchase is concluded.
